5. Moreover, the differences between grey and ductile cast iron mentioned above only affect the required design of the casting (i.e. whether a locking device is required), but not the fitness for the purpose of the casting, which is to cover and/or give access to ground or sub-surface systems.
6. Secondly, section two (product) mentioned that castings made of non-malleable cast iron of a kind used to cover and/or to give access to ground or sub-surface systems would be covered, but without further specifying what could be understood as ‘non-malleable’.
7. As mentioned above, there it is stipulated that ‘castings are generally comprised of a frame, which is embedded in the ground, and either a cover or a grate, which sits flush with any surface used by pedestrians and/or vehicles and which directly withstand the weight and impact of pedestrian and/or vehicle traffic.
8. ‘crops under glass or high (accessible) cover’ means crops which, for the whole of their period of growth or for the predominant part of it, are covered by greenhouses or fixed or mobile high cover (glass or rigid or flexible plastic). This excludes sheets of plastic laid flat on the ground, as well as land under cloches or tunnels not accessible to man or movable glass-covered frames. Areas of crops which are grown temporarily under glass and temporarily in the open air are reported as entirely under glass, unless the period under glass is of extremely limited duration;
9. By Regulation (EC) No 1212/2005, the Council imposed a definitive anti-dumping duty on imports into the Community of castings of non-malleable cast iron of a kind used to cover and/or give access to ground or sub-surface systems, and parts thereof, whether or not machined, coated or painted or fitted with other materials, excluding fire hydrants, originating in the People’s Republic of China (‘PRC’) (‘the product concerned’), normally declared within CN codes 73251050, 73251092 and ex73251099 (Taric code 7325109910).
10. Secondly, section two (product) mentioned that castings made of non-malleable cast iron of a kind used to cover and/or to give access to ground or sub-surface systems would be covered, but without further specifying what could be understood as ‘non-malleable’. It is recalled in this context that the CN codes mentioned in the Notice of initiation were explicitly ‘only given for information’ and thus can not be argued to have limited the product scope of the original investigation.
11. If the field is larger than 3 hectares, the field shall be divided into sublots of 2 hectares and each sublot shall be sampled separately. Incremental samples shall be collected by walking a ‘W’ or ‘X’ shaped pattern across the field. Crops harvested from narrow beds or area under cover shall be harvested in a ‘W’ or ‘X’ shaped pattern from several beds and pooled to form the aggregate sample. Plants must be cut at ground level.
12. A definitive anti-dumping duty is hereby imposed on imports of castings of non-malleable cast iron and spheroidal graphite cast iron (ductile iron) of a kind used to cover and/or to give access to ground or sub-surface systems, and parts thereof, whether or not machined, coated or painted or fitted with other materials, excluding fire hydrants, originating in the People’s Republic of China, currently classifiable within CN codes 73251050, 73251092, ex73251099 (Taric code 7325109910), and ex73259910 (Taric code 7325991010).’.
